Arrest Request Enlivens City Council Meeting

Cooperative independence’ seen as best
approach to join in fight against truck traffic

Ventura County resident Carol Dean Williams strutted to the City Hall podium at Tuesday night’s City Council meeting and told the City Clerk Carlon Strobel that he was going to arrest her, to the dismay of council members.
“Any person who reports to a police officer that a crime has been committed can make a citizen’s arrest and she has committed a crime,” he said. “I have a recording of it right here.”
But by the time Williams had exhausted his three minutes of public comment, he had not made clear the crime of which he was accusing her.
Ojai Police Capt. Bruce Norris came to the podium and clarified that no such arrest would be made.
Up until recently, the penal code mandated that law enforcement take any citizen’s arrest. Though the validity of the arrest would be determined in court, the initial arrest was required. But a supplement added in 2002 gives officers the discretion not to accept the citizen’s arrest, said Norris. In this case he did not find an appropriate cause for arrest.
Strobel explained later that Williams had visited the City Hall earlier regarding his concern about the flood control berm west of the San Antonio Creek that is currently being raised to safe guard Casitas Springs from flooding. He was concerned that raising the berm would endanger a nearby bridge, she said.
When he asked Strobel if the city would intervene, she told him to speak with the city manager to see if he would consider placing the item on the agenda, according to Strobel. Then he got very upset and pulled out his tape recorder, she said
“I think that’s when he got sidetracked.” she explained.
After an extended, slightly confrontational conversation at City Hall that day, Williams had been escorted out of the administrative office by Norris, said Strobel. That incident, she speculated, was the cause of his attempted citizen’s arrest at the meeting Tuesday night.
In other City Council news, council members directed city staff to continue to work on the issue of Ojai’s gravel truck traffic independently but in cooperation with the citizen’s group, the Committee to Stop the Trucks.
Council members had agreed that the city should get involved in the battled against increasing truck traffic in mid-June. On Tuesday they decided that “cooperative independence” was the best approach, to start.
Other ways to address the gravel truck issue would be to offer a cash contribution to the citizen’s group. Such a donation would not be considered a gift of public funds as long as the city could show that the gift would have a definite effect on the community. City manager Jere Kersnar explained that such an effect could be demonstrated.
Kersnar also offered the option of creating a consortium but warned that it might be difficult to administer and might require a long-term commitment from the city.
Also during the meeting S.A.F.E. Coalition representative Ruth Cooper announced that the percentage of local 11th-graders being very drunk went down 16 percent since 2002 and the percentage of 11th-graders being under the influence of drugs or alcohol at school went down by 10 percent, according to a California Healthy Kids Survey. Ninth-graders under the influence of drugs or alcohol at school went down by 6 percent. A 2007 survey of seventh-11th graders showed an overall increase in substance abuse among seventh graders however.
The S.A.F.E Coalition plans to focus on implementing and enforcing the new Social Host Ordinance which penalizes anyone hosting a party with underage drinkers and educate parents in substance abuse prevention particularly among young teens, said Cooper.

148.5. (a) Every person who reports to any peace officer listed in Section 830.1 or 830.2, or subdivision (a) of Section 830.33, the Attorney General, or a deputy attorney general, or a district attorney, or a deputy district attorney that a felony or misdemeanor has been committed, knowing the report to be false, is guilty of a misdemeanor.
834. An arrest is taking a person into custody, in a case and in the manner authorized by law. An arrest may be made by a peace officer or by a private person.
837. A private person may arrest another: 1. For a public offense committed or attempted in his presence. 2. When the person arrested has committed a felony, although not in his presence. 3. When a felony has been in fact committed, and he has reasonable cause for believing the person arrested to have committed it.
840. An arrest for the commission of a felony may be made on any day and at any time of the day or night. An arrest for the commission of a misdemeanor or an infraction cannot be made between the hours of 10 o'clock p.m. of any day and 6 o'clock a.m. of the succeeding day, unless: (1) The arrest is made without a warrant pursuant to Section 836 or 837. (2) The arrest is made in a public place. (3) The arrest is made when the person is in custody pursuant to another lawful arrest. (4) The arrest is made pursuant to a warrant which, for good cause shown, directs that it may be served at any time of the day or night.
841. The person making the arrest must inform the person to be arrested of the intention to arrest him, of the cause of the arrest, and the authority to make it, except when the person making the arrest has reasonable cause to believe that the person to be arrested is actually engaged in the commission of or an attempt to commit an offense, or the person to be arrested is pursued immediately after its commission, or after an escape. The person making the arrest must, on request of the person he is arresting, inform the latter of the offense for which he is being arrested.

MEASURE “C7” required twenty-one pages to describe “a communication services tax.” Otherwise known as a Utility User Tax.

OUCH! My head hurts after reading the twenty-one pages.


GOUGING! Our State Senator petitioned to stop this utility user tax gouging! Because this tax is imposed as a percentage of our utility user bill. When our utility user bill increases, this tax automatically increases due to the percentage rate. There are many reasons for a utility user bill to be increased.


Our city's proposed utility tax revenue for FY 2007-08 is $9,387,425.00. Ouch! Stop gouging!
Voters of Berkeley, California spoke: NO 62.6% Yes 37.4% about this kind of tax.
No votes are positive. Deficit spending is a negative. Your no vote can stop deficit spending.


A rough truth versus a smooth deception:
“Maintenance of essential city services while decreasing tax rates” is a mix match of words found through out the twenty-one pages which, if approved by majority vote, would add a new chapter to the San Buenaventura Municipal Code. A new chapter to increase taxes using a percentage rate which would automatically increase this tax without any further voter approval.


This tax is a general tax which means it can fund any city services and cannot be set apart for any specific use.


No sunset clause. No accountability. Your no vote is a positive message to our elected city council members.


Apply the brakes and stop excess taxes when you cast your ballot.

Dear RLUE:

I agree WITH councilmembers Brennan, Andrews, and Morehouse on July 23, 2007 when they voted AGAINST changing the 5% to 4.5% for the Utility User Tax. If this sounds strange to you, they were right because that allowed councilmembers Summers and Fulton to write a complete deceptive ballot Argument In Favor of Measure "C7."

Our Election Laws protect the voters against this kind of fraud. But it takes a court action to enforce these laws.

Please read the TWENTY-ONE pages of this UUT and you will have a headache, guaranteed!

And if you are following our school board members, they have refused to produce public records on the security cameras at Ventura and Buena High. I can agree with them on that kind of conduct. Plus, they keep repeating their bad public behavior.

I offer DVD's this campaign season to fully prove my every issue.

Plus, I do AGREE with what I have been told first hand about our new city attorney upholding our city charter where our past city attorney refused and failed to do so.

I agree with everyone who knows the facts and the law. For example, I met with Liveable Ventura. And they repeatedly asked me leading questions about Wal-Mart buying the K-Mart on Victoria. I had know choice but to tell them: "No one, not our city council nor the president of the United States can STOP Wal-Mart from buying the current K-Mart AS IS. That's the fact and the law.

Our new city attorney hails from Boulder, Colorado.

I agree that Wal-Mart can buy the K-Mart on Victoria AS IS. I do question WHY Wal-Mart would want another store so close to the one in Oxnard? I have emailed the CEO of Wal-Mart and asked him why?

I do research. I enjoy it. If elected, I would fully explain the background for every vote I made, period.

I firmly believe every elected official must fully explain their vote on the issues.

Also, I will fully explain my position so that any other citizen could then raise issues about mine.

Dear Crime?,

Ventura County Campaign Finance Reform Ordinance 4361.

You can find it on the County of Ventura website.

Short summary: Candidate Steve Bennett collected campaign funds before he was authorized to collect the funds. Four years ago, he stated he was "CHAMPION" of campaign finance reform. Surely, he knew his own Ordinance since he was its author.

On another post you asked my position on an issue before the Ventura City Council.

As I don't live in Ventura nor do I follow the policies of your fine city I don't feel qualified to give you a thoughtful answer.

With that being said, thanks for asking.

Feel free to ignore non-important posts and answer serious questions.

My question for you is this:

If you could learn one thing from a way another Ventura County city does something which city would you choose and what would you be happy to duplicate.

My first official visit to Ojai City Hall was on June 28, 2007. For no reason the city clerk had the police called on me. I am use to that. So I would not pick Ojai. Ventura use to do that also. Oxnard never did.

I would pick Ventura County Board of Supervisors. Because their CEO, Johnny Johnston, has worked together on several very important issues and the County has overcome certain fears of First Amendment rights when a citizen exercises it fully as intended by our founding fathers.

Take the levee at Casitas Springs. I am having a meeting on August 17, 2007 with the CEO and Public Works.

Take online government postings. I have pointed out weakness in this computer day and time when government wants to be paperless. Johnny has listened. Johnny has acted and we have gotten results by allowing the truth to guide us.

Ventura Mayor Carl Morehouse on Thursday joined what is rapidly becoming a crowded field vying for City Council seats this fall.

On the steps of City Hall, Morehouse announced that after weeks of deliberation with his wife, he would seek a third term, mostly because so many people have urged him to.

"Like Cincinnatus of ancient Rome, I am willing to serve when my community calls," he told about two dozen people gathered for the noon announcement.

Other challengers include perennial candidate Brian Lee Rencher, attorney A. Kimball Ouerbacker III, Lou Cunningham, Jerry Martin and Carroll Dean Williams.
