Police Investigate Fierro Drive Incident

Information sought on Monday's altercation

Ventura County Sheriff’s Department investigators are trying to determine what happened just before a 22-year-old Hispanic man was struck by a vehicle in the 1100 block of Fierro Drive Monday afternoon.
According to Ojai Police Chief Bruce Norris, some sort of altercation outside the single-family home between residents and a group of young males, who may have left the scene in a black Ford Explorer, preceded the incident.
The back window of the Explorer may have been smashed by a rock or hammer.
The victim was Mario Oseguera, 20, of Ojai. He was transported by ambulance to an awaiting helicopter at the landing zone at the former Sheriff’s Honor Farm on nearby Baldwin Road, and then to Ventura County Medical Center. He was reported to have a broken leg and head trauma.
A 1993 blue Chysler New Yorker at the scene showed evidence of significant front-end damage. The windshield was thoroughly caved in. Both sides of Fierro Drive were cordoned off, with a pool of blood visible in the street.
Daniel Charles Rockett, 19, of Ojai, was arrested at the scene on an unknown charge.
“This was a confrontation between two rival groups of males,” said Sheriff’s Capt. Bill Boyd on Wednesday. The Sheriff’s Department was unable to confirm by press time whether gang members were involved in the fight.
The incident, although turned over to the California Highway Patrol as a traffic incident, is under investigation by the Sheriff’s Department Major Crimes Unit.
The driver of the car was reported as Matthew de la Cruz, 18, also of Ojai, according to CHP officer Shawna Davidson.
Two ambulances responded to the scene of the fight. According to an eyewitness at the scene, the victim was unconscious and unresponsive.
Anyone with information on this event is urged to call the Sheriff’s Department at 646-1414.

Both Rocket and De La Cruz are in M.O.B Miners Oaks gang, and should be arrested on charges of vehicular manslaughter and benefit of a street gang. Please do your job OPD.

An article in the Ventura County Star last year included Matthew DeLaCruz talking about his meth use. Would this arrest be enough to require drug testing and a thorough search of his house????? Danny Rocket has broken car windows before. Both of these guys need to be taken off of the streets for a VERY long time!

Read the article a little closer. The only arrest so far in this incident is that of Daniel Rockett for an "unknown charge." He was seen totally out of control, getting in the faces of the police and they finally cuffed him and put in in the back of one of the police cars. There was no mention of DeLaCruz being arrested.

The Ojai Police Department called in the California Highway patrol because they knew it was a problem between two rival gangs....and the OPD knew that the CHP would be more ignorant to what had happen in other word the OPD in covering up the fact that there was any type of gang involvement, and OPD knew they would have to add charges of attempt of vehicular manslaughter, criminal threats, and benefit of a street gang.

The police are neither stupid nor oblivious to the problems in the neighborhood. They need to conduct a proper investigation in order to file the right charges and ensure a conviction based on the EVIDENCE in the case. A jury will not convict anyone based on a bunch of neighbors saying some bad stuff must have gone down.

It cannot be stressed enough that all citizens are innocent until proven guilty. I sense that too often in these comments people are anonymously making accusations and rushing to judgement. I would like to see this forum being used more constructively than just as an outlet for gasbags.

And so there's no confusion, the word "blog" refers to the collection of articles posted by the authors of this site, and the comments posted here shouldn't be referred to as "blogs" but as "comments."

i personally know athew myself and i know as a fact that he was driving the car, and did mean hit Mario with the car. i don';t think however he realized the consequences until after. But he has been arrested, and is in juvenile hall for violation of juvenile probation. I do agree that matt and rockett should be taken off the streets, because a lot of the gang problems revolve around these two boys...

i think that wat the press says isnt always right and you cant point fingers and say that only two people need to be takin off the street. i know from facts that osl gang had to do with this inccident and they have always been the main problem in meiners oaks, ojai and oak view and i dont think its right that only they should be put away the police havnt even tryed going and looking for the 4 other males involved in this incident so i think everybody should think about all the things and evdince that not just rocket and de la cruz have done something but that the osl gang have been causing alot of problems in this area

If the last two posts are from friends of Rocket and De La Cruz, I am not sure that they are helping their buddies all that much. It is true that ANYONE engaged in destructive activities needs to be stopped, but that does not absolve these two young men. By the way, PRESUMED innocent until proven guilty is for the purposes of the court, it does not mean that all those accused of crimes are ACTUALLY innocent. If prior behavior is any indication, I think there is a good chance that these two ARE guilty. If we need to add to the sweep, fine.

I'm not a friend of the accused, and as far as I know everything being said about him is true, but regardless of this he should receive the due process afforded any of us. I'd also like to believe that any punishment would be corrective, because historically it's an incredible drain on society if it isn't. I also believe that the vigilantism attitudes being slung around here are rather unsavory for what I have observed as an enlightened community. I only suggested that there's a reason we're seeing a spike in gang activity, and that the answer isn't a bigger gulag. Our country and community is better and more proud than that -- and we should endeavor to correct our problems, not brush them under the rug.

I also believe that the vigilantism attitudes being slung around here are rather unsavory for what I have observed as an enlightened community.

The "enlightenment" you think you see in Ojai belongs to people who have never had their lives adversely affected by the criminals they like to defend and coddle at a very safe distance. The day that they or someone they care for become victims is the day that their opinions, their beliefs, and their actions will change.

I lived and worked for decades in areas with much worse gang problems, and in areas where gunfire was heard not only every night but in the daytime as well. We weren't surrounded by kids who had recently gone astray, we were surrounded by gangsters who had grown up in the gang culture, and whose parents and grandparents had also grown up in the gang culture. Some of them were as smart as anyone you've ever met in your life, and they ate at least one or two well-meaning do-gooders for breakfast every week after playing with them the way a cat plays with its prey. The local cops weren't doing much more than trying to get the gangs to kill each other off by starting rumors about how gang A had dissed gang B. My last place of residence before moving to Ojai was a neighborhood where cops often ran red lights and stop signs whenever possible because they didn't want to be sitting ducks at a traffic stop, especially at night. Most of the cops there really didn't care what the gangs did to non-cops because as far as they were concerned we were the ones who kept knocking them back and tying their hands every time they tried to deal with the problem. Things had gotten to the point where the cops mostly only responded to direct confrontation and attacks on their families and extended families. The rest of the time they just came by and took reports after the fact. They took reports, and the problems continued. Why? Because, generally, we didn't support them and they knew it and they weren't going to risk dying for people who never, ever, had their backs.

You want to know how things got to be as bad as they were there? People used to figure that the gangs weren't a problem because they were only mostly killing each other, and because every time a gang member assaulted or killed a non-gang member some fuzzy-headed apologist would wind up getting a page-and-a-half in the L.A. Times explaining how it was all the fault of the gangsters' socioeconomic surroundings, and therefore the fault of everyone who was better off than the gangsters. And, all of the guilt-ridden liberals and "enlightened" people bought all of this and subsequently made yet more laws that made it even harder for the cops to stop gangs and crime in general.

That's where we're headed here. You don't want to believe it, but there are plenty of people here who know that it's true. Some of you want to live with your head in the sand or perhaps fantasize about how maybe an after-school arts & crafts program would be just the thing to bring these kids back from the dark side. Dream on.

In reality, what you're seeing today is just one of the steps along the way to Ojai becoming Huntington Park or Lincoln Heights or Alhambra or Inglewood or Compton or any number of other places where people used to live in relative peace. If you want to refer to people who don't want to be cringing in fear in what used to be nice neighborhoods as vigilantes, so be it, but your definition is incorrect. Some of us know better than to believe what you're saying because we've met your kind before, (and some of us used to be your kind) and we don't care what you think because you don't know what the hell you're talking about, and there's a good chance that you won't know anything at all until someone you care for is lying on the street in a pool of blood, or one of your children gets killed in a drive-by while he or she is sitting on the couch watching TV.

You know it happens. Do you want it to happen here? What will you say when it does? There's nothing you can say, and nothing you can do that will do any good after someone you love has died for no other apparent reason than to demonstrate just how horribly wrong and insane things have become.

see this is why all these comments are making me mad because the press only gets half the story not all because if they did have the hole story no one would be commenting wondering what happened de la cruz got chased from mc donalds to the rockets house they ran out (osl)of the car bashed in the rockets house window also popped a tire rocket ran out bashed there window de la cruz was trying to get away from (osl) and one of the osl boys got in the middle of the street de la cruz swerved from the car doors of the other car and one of the osl boys accidently got hit. so dont go pointing fingers and saying that only rocket and de la cruz where the one's starting this because they didnt and its ridiculous how people just dont want to look at the problem at hand we do have a gang problem and yes it's not as bad as compton but this is a small community and we all need to do are job and help out from stoping this happen because inncent people are getting hurt i know from experiance that this osl problem we have needs to get handled and there IS NO M.O.B they just live in meniers oaks and there not going to get charged with vehicular manslaughter because it was an accident so everyone needs to look at the big picture and stop pointing fingers and look at everything (osl) has done to this community

If there is no MOB, why is there MOB graffiti all over, and why is that those in the non-existent MOB gang are the most vocal about the OS?. From the grammar and spelling, members of the MOB and OSL could stand to spend a few more hours in the classroom. Perhaps then they could fill out a job application and solve their own problem.

Drugs, as well as gangs, is a serious problem in Ojai. It sounds as if drugs played some role in the initial altercation, if only in bringing these deadbeats together. We need to do a better job as a community in keeping drugs out of our kids and out of our community. Parents that look the other way, or, even worse, supply drugs and alcohol need to think very hard about what they are doing. Neighbors need to get as nosey as they were 30 years ago. I couldn't do anything in the valley without my parents hearing about it. I am sure the parents of many of these kids would actually appreciate hearing what their kids are up to, and, if not, maybe they will get so tired of hearing it that they will take action as parents.

this all has to do when danny rocket got hit on the head with a bat or something and thinks it was them that did it.so he getting them back by using the car as a weapon.the victim was jus heading to his friends house.there was no cars then all of a sudden a car comes by fast and hits him.some say it was an accident i deffinently know it was no accident.if anything, the victim should press charges because he did nothing to diserve what he got

If it was an osl gang member who hit someone they would be taken in right away.But since it was a white boy they the police officers dont think anything of it.How do you know that the white boys didnt start it. exactly knows. i think that de la cruz needs to pay for all the damage he put oseguera throught regardless if was an accident or not! does he even have his licence? I think the County of Ventura should bill the Fierro Drive family for all of the time the police have spent at their place. Maybe hitting these low lifes where it counts would force them to be accountable for what their kids are up to. Better yet, put the whole bunch of them to work filling potholes with hot asphalt in the 100 degree heat. Get them all so freakin tired like the rest of us working folk that they do not have the energy to start crap. You do not have to spell to make a shovel work. Sitting in an air conditioned cell having meals handed to you not enough punishment in my book.

We are judging behavior, in this case. When young men act aggressively, act out violently, lie about it, challenge police who are simply trying to find out the facts, drink and drug every day to the point where the whole neighborhood knows it, then this is behavior that doesn't make a good citizen or neighbor. It is dangerous to be around people like this. Most people just mind their own business, and never get a second look. These punks seek out attention for their behavior, and then cry about it when they are "judged" to be criminally inclined.

Reading all the comments its clear there is a lot of frustration, and a lot of misinformation and strong if uninformed opinions. This was the result of a confrontation. There are no "imnocent" parties here; the "victim" wasn't walking to a friends house; the window glass of the vehicle he came in was on the street near where the victim's "friends" left him. Nobody's favoring the white boys or the osl. The Sheriffs know what happened. Let them do their work.

If anyone knows of or is a Laywer, you should contact this Mario kid who got hit by the car and convince him to file a civil lawsuit. One aginst the Insurance company, two against the driver, and three against the owner of the vehicle if it proves not to be owned by the driver. This Kid has the potential of walking away with alot of MONEY as well as his attorney. Suing is the American Way!!!

The comment about letting the Sheriff's do their work is a joke. Maybe if they had done some better work after some of the previous confrontations at this location things would not have escalated to the point where there was blood on the road.

And to the ambulance chaser who thinks the Mario kid should sue everone in sight should put a bit more thought into the thought. It is obvious these people are not rolling in the bucks. We would not be surprised if the car involved in uninsured.

We were anxious to see a follow-up story in the Friday issue of the OVN. Any arrests? Condition of the man who was run over. This seems to happen alot. Big story and then you never hear anymore about it. What ever happened to that movie guy who killed his friend in the car accident months ago?

this is BS 20+ years ago i got citations all the time loitering more than 3 in a group was a gang50.00x3 citation curfew citations at 9:15pm75.00x4 riding against traffic 55.00x2not getting off my bike to cross the street 40.00x4 no bike light at 6:00pm in summer time 100.00x2 cutting across traffic {not curb to curb}30.00x3 riding on the side walk 150.00x2 and my favorite one unsafe speed on a bicycle 32mph i started laughing at the cop i really did not think he was going to ticket me 120.00x1 all in just 3 1/2 years 1430.00 in fines still have those yellows i payed all with the cash i made getting those tickets {to and from work and school}not drug dealing or any thing illegal in my case guilty till proven innocent but the one i never got was a helmet ticket they just passed that law after i turned 18. so none of those laws are applied now ??????? standing on the street corner 15+ in the street in most cases and blocking stores i have no problem with day labors but i have no use for them,and every county files a gang injunction when all laws necessary are in place but not enforced and adding new ones will fix this ???BS

sorry to July 11 11:49am it is not old school latinos its o----- serrinos locos{osl}sur13 tag that is all over ojai,oak view,m.o.danny is justified to attack and defend his street it was the street he lived on right. that's not all i think 2-3 cars of his have been more than just vandalised tooth past and toilet paper are vandalism slashing tires and breaking windows is chichens@#$ and attacking someones house no respect or accountability a 1 on 1 confrontation is 1 way to solve this but it is a little bit to fair for osl style if 6+ members of skins smashed a car and house and well a kid.Hate crime in ojai would have been the headlines but six against 1-2 at there house maybe they wanted to talk right the peaceful group called osl would never out number someone and intend inflict great bodily harm it just really takes half a dozen to equal 1 man not my opinion there action says that clearly danny should have stayed out of it but it is inevitable. if they were not at his house that incident would have been avoided that is what makes there action wrong not background not race or gang affiliation or a judgement call those are facts

Two wrongs to do not make a right. One cannot take the law into one's own hand. The Rocket or De La Cruz, who ever was drivings, commited a crime regardless of what events led up to it. They crossed the line when they decided to get into the car and pursue, the law only allows one to defend with neccessary force, Not to become the aggressor. In short all those involved who commited a crime should be charged. It does society no good to prosecute one side but not the other when both sides have commited a crime.

well cops always show great restraint when it comes to life/death situations 6-1 they could accidentally kill someone jumping them. You're not getting it. I don't have to tell you anything; I'm not the one that wants money from you. You want money from me. The school lobby is asking citizens for yet more money. The school lobby is the one that has to come up with an idea, and prove that more money will equal an improved educational experience.

Speaking of follow-up, whatever happened to Jeff Furchtenect's SLAPP suit against the City of Ojai? According to the OVN article back in May, it was set for the State Court of Appeal, Second Appellant District, oral argument on July 11.

Sheriff's investigators have not released any new information as of an today. The investigation is ongoing, and we will report on further developments as they are released.

To answer the question about the lawsuit involving Jeff Furchtenicht and the City of Ojai, an oral argument was held on July 9. The judge will make a determination in 30 to 60 days from that date. Look forward to an update in a month or two.

in my humble opinion, anyone who makes the left turn onto Tico Rd off the 33 should be pulled over and searched, then they should be made to recite the alphabet. when they fail to do so, they should be locked up for life and sterilised for being so stupid!
i've never seen a good driver take that left turn! just a bunch of arrogant, punk-a@#, overpriveleged kids on meth!

Arrests were made 7/30 with more expected. Information will be posted here 7/30. Mario Oseguera is "recovering well from his injuries," according to a source.
